About the Interim Final Rule

The Centers for Medicaid & Medicare Services (CMS) released to the Office of the Federal Register their interim final rule with comment period as a special filing at 4:45 pm on June 1. WCHSA will submit comments on this final regulation. Join the cross-PAC workgroup to provide feedback on the Association's comments! This will be atleast two meetings. The first is 2 hours going over the rule and the second is for additional feedback.

  • Defines medically frail as having a special medical need that significantly impairs the beneficiary’s ability to meet the work requirements.
  • For 2027, states to use existing data to document whether beneficiaries meet an exemption, including verifying medical claims that show they have disabilities that prevent them from working. If that data is not available, then the individual can self-declare that they have met the exemption.
